Charges for driver, trucking company include defective odometer

The driver and trucking company were both hit with numerous charges after the OPP responded to a complaint on Highway 11 in Temagami

On January 27, 2025, at approximately 10:15 a.m., members of the Temagami Detachment of the OPP responded to a traffic complaint on Highway 11 in Temagami.

TEMAGAMI, Ont. — The Ontario Provincial Police reports a traffic complaint led to an operator and their trucking company being charged with several provincial offences.

On January 27, 2025, at approximately 10:15 a.m., members of the Temagami Detachment of the OPP responded to a traffic complaint on Highway 11 in Temagami.

Police located the commercial motor vehicle (CMV) and performed a Commercial Vehicle Safety Alliance (CVSA) inspection which resulted in several charges under the Highway Traffic Act (HTA) as well as the Towing and Storage Safety and Enforcement Act (TSSEA).

A 39-year-old driver of Brampton was charged with:

  • Drive CMV with major defect in it or drawn vehicle (HTA)
  • Fail to enter defect in daily inspection report (HTA)
  • Fail to accurately complete daily inspection report (HTA)
  • Defective odometer CMV (HTA)  
  • Fail to comply with certificate conditions (TSSEA)

The company from Brampton, was charged with:

  • Fail to ensure daily inspection is conducted properly (HTA)
  • Fail to ensure daily inspection report is accurately completed (HTA)
  • Fail to ensure performance standards are met (HTA)
  • Defective odometer - CMV (HTA)
  • Fail to comply with certificate conditions (TSSEA)

The CMV was placed out of service where it will remain until the repairs required are completed.
